Nova Scotia Waitlist Settlement

Claims Period now open

The Supreme Court of Nova Scotia approved the Nova Scotia Waitlist Settlement on November 12, 2025.

This Settlement applies to people in Nova Scotia who were eligible for disability services under the Social Assistance Act through the Disability Support Program but were put on waitlists for those services or placed in Institutions, Nursing Homes, or Hospitals between April 1, 1998, and August 25, 2025.

Class Members or their representatives can submit a Claim for compensation from December 17, 2025, until March 17, 2027.

Claim Forms

Claim Forms are now available for download. You can also complete your Claim online starting early 2026 at Portal.NSWaitlistSettlement.ca.
There are four Claim Forms for this Settlement. Please review the options below to determine which forms you need:

  • Claim Form 1 – Application: All applicants must complete this form. If you are submitting a claim for yourself, this is the only form required. You must include a copy of your government-issued ID.
  • Claim Form 2 – Personal Representative: If a Class Member is unable to complete their own claim because they are a Person Under Disability (as defined in the Adult Capacity and Decision-making Act, S.N.S. 2017, c 4), their legally appointed Personal Representative may submit a claim on their behalf. A copy of government-issued ID and proof of legal appointment are required. Both Claim Form 2 - Personal Representative and Claim Form 1-Application must be submitted.
  • Claim Form 3 – Executor or Administrator: If you are the legally appointed Executor or Administrator of a Deceased Class Member’s estate, you may submit a claim on behalf of their estate. You must provide government-issued ID, proof of legal appointment, and proof of death. Both Claim Form 3 - Executor or Administrator and Claim Form 1 - Application must be submitted.
  • Claim Form 4 – Next-of-Kin Representative: If a Deceased Class Member does not have a legally appointed Executor or Administrator, a relative may submit a claim on their behalf. Although any relative can submit a Claim, only the Deceased’s Nearest Relative (spouse, child, grandchild, etc.) can receive compensation. To prove your relationship, you must include documents like a marriage or birth certificate and provide information about other family members. You also need to show that you informed the other family members about the Claim and record their responses or any objections. The Claims Administrator needs this information to validate who is the Nearest Relative and to prioritize if there are multiple Next-of-Kin Claims for the same Class Member. Both Claim Form 4 - Next-of-Kin Representative and Claim Form 1 - Application must be submitted. You must also provide:
    • A copy of your valid, government-issued ID (please don't send originals)
    • Proof of death
    • A declaration sworn before a notary, lawyer or commissioner of oaths
    • A statement signed by someone who knew the Deceased Class Member for at least five years
    • A statement signed by a licensed professional (like a doctor, lawyer, or accountant) who has known you for at least five years.

How to submit Claim Forms

There are different options for submitting Claim Forms:

  1. Online: Starting end of January 2026 visit Portal.NSWaitlistSettlement.ca to create an account and submit your Claim.
  2. Email: Download Claim Form 1 - Application (and the relevant Representative Claim Form if applicable) and email it to Claims@NSWaitlistSettlement.ca
  3. Fax or Mail: Print the relevant Claim Form(s) or request a copy from the Claims Administrator, then fax it to 902-450-4956, or mail it to:

Remember: All Claim Forms and all supporting documentation must be received by the Administrator by March 17, 2027.
