Nova Scotia Waitlist Settlement

Settlement Approval Hearing Scheduled for November 7, 2025

A Settlement Approval Hearing has been scheduled for the Isai Estey v. The Attorney General of Nova Scotia class action lawsuit, known as the “Nova Scotia Disability Services Class Action.” The hearing will take place on:
Friday, November 7, 2025 at 9:30 a.m.

At this hearing, a judge decides whether the Settlement that the plaintiffs and defendants have agreed on is to be approved by the court. Anyone who disagrees with the proposed Settlement, the proposed lawyers’ fees, or the proposed honorarium for the representative plaintiff must file an objection by October 27, 2025. To file an objection, you need to complete and sign the Objection Form, then send it to the Notice Administrator on or before the objection deadline. If you don’t want to be part of this Settlement, you must complete and sign an Opt-Out Form and send it to the Notice Administrator by October 27, 2025. Objection Forms and Opt-Out Forms should be sent to:

  • Mail: Please use email or fax only to submit your Objection or Opt-Out Form while there is a Canada Post mail strike.

If you want to make a Claim, you don’t have to do anything until after the Settlement is approved. Check this website or Class Counsel’s websites regularly after the Settlement Approval Hearing to see if the Settlement has been approved. The nation-wide postal strike will affect the timely delivery of mail related to this proposed Settlement, like Objection and Opt-out Forms.

If you plan on submitting an Objection or Opt-Out Form, or writing a letter to the Notice Administrator, please send it by email or fax until after the postal strike ends.
